| TERMS | Our regular terms are 30 days from shipping date. Cash or wire transfer will be required from our new customers until credit has been established. |

FINANCE CHARGE (Interest) |
A finance charge (interest) of 1.5% per month (18% per annum) will be assessed to any unpaid balance older than 30 days from shipping date. |
| PRICES | All prices are F.O.B. Wekiwa Gardens, Inc., Apopka, Florida. |
| INSPECTION | There is an additional charge of $55.00 per shipment leaving the United States that will be charged for Phytosanitary permits. |
| CANCELLATION | If cancellation is necessary on any order, it must be done no later than the day before shipment. Otherwise, a charge will be made for materials and labor involved in unpacking and returning the plants to inventory. |
| CLAIMS | Wekiwa Gardens, Inc. must be notified within 48 hours of receipt of any damages or claims against products shipped. The shipper retains the right to refuse claims not properly reported. Claims for damages during transportation, i.e., delay, freezing, breakage, etc., must be made by the customer with the carrier. The carrier's inspection report is required. We accept all orders subject to prior sale and on the condition that orders shall be void should stock become damaged in any way beyond our control. |
| GUARANTEE | Wekiwa Gardens, Inc. warrants to the extent of the purchase price that all nursery stock is sold true to name and as described within recognized trade tolerance. We give no further warranty, expressed or implied, and will under no circumstances be liable for more than the invoice value at the time of purchase. |
